Legal Considerations:

All workers and private individuals who are in or on our MEWP are covered by Cherry Green's insurance for loss or damage resulting from the normal use of the cherrypicker, as long as a Cherry Green Crewman is in control of the vehicle.

Cherry Green's Insurance will not cover misuse of the controls by anybody other than a Cherry Green PAL-qualified crewmember.

Responsibility for the actions of a worker in pursuit of a trade (i.e. what is being DONE from the access platform) resulting in loss or damage are as follows:

Customer's worker: Customer

Cherry Green's worker: Cherry Green

Specialist 3rd party contracted-in: 3rd Party company

A 'worker' is either an employee or self-employed labourer for the company.

If a Cherry Green Operator is assisting a tradesperson in the performance of a trade, the trades company represented assumes liability for loss or damage caused by our operator in the performance of that work.

Access vehicles and machinery are heavy. They may damage floors, lawns or hardstanding. Cherry Green accepts no liability for damage to floors or ground of any description arising from the passage or setting up of access equipment.

Please note that flagstones and paving slabs can be susceptible to cracking if a MEWP wheel or track passes over the top, especially if the sub-base is not level.

Although our crews will try to assess as best they can the risk to the ground surface material before passing a machine over the top, Cherry Green accepts no liability for unforseen damage.

If there is a void under any surface (e.g. a chamber, sewer, drain, culvert, cellar or well) it is imperative that the Cherry Green crewmember is made aware of this.

Cherry Green can not be held responsible for any consequential loss arising either from access operations or from lack of performance. A variety of factors can affect the performance of a contract, including but not limited to: weather, temperature, breakdown, the need to withdraw equipment from service for maintenance or legal requirements, the discovery of unknown factors, unsatisfactory results of a risk assessment, illness, or inability of the machine to reach the work target. Our crew members have the absolute right to terminate operations at any stage if they are aware of factors increasing risk or likely to breach legal requirements.
